Fair and Transparent Refund Policy

This policy complies with the Consumer Protection Act, 2002, S.O. 2002, c. 30, Sched. A, and applicable Ontario consumer protection regulations. We are committed to fair treatment of all customers.

1. Overview

Ontario Permit & Compliance Snapshot ("the Service"), operated by 1000144294 ONTARIO INC ("the Company"), provides AI-generated informational reports as digital products. This Refund Policy governs all purchases made through the Service and is incorporated by reference into our Terms of Service.

We understand that purchasing a digital product requires trust. This policy is designed to be fair, transparent, and compliant with Ontario consumer protection law while reflecting the immediate-delivery nature of our digital reports.

2. Nature of the Product — Digital Delivery

Reports purchased through the Service are digital products delivered immediately upon generation. When you complete your purchase:

  • Your report is generated by AI within approximately 2–5 minutes;
  • The completed report is immediately available in your dashboard;
  • The report remains accessible in your account for future reference;
  • The digital product is considered "delivered" once the report appears in your dashboard.

By completing your purchase, you expressly acknowledge that you are purchasing a digital product that is delivered immediately, and you consent to the immediate performance of the service. This acknowledgment is consistent with Section 37(2) of the Consumer Protection Act, 2002 regarding the supply of digital content.

3. General Refund Policy

Successfully Delivered Reports

Non-refundable after delivery. By completing your purchase, you acknowledge that you are purchasing a digital product delivered immediately.

Refund Request Window

Eligible refund requests must be submitted within 14 calendar days of the original purchase date.

4. Eligible Refund Scenarios

Refunds are available in the following limited circumstances, subject to verification by the Company:

4.1 Technical Failure — Full Refund

If the report generation process fails and no report is delivered to your dashboard, you are entitled to a full refund. This includes:

  • System errors that prevent report generation from completing;
  • Payment processed but no report generated;
  • Persistent technical errors that prevent you from accessing a generated report, where the Company is unable to resolve the access issue within 5 business days.

4.2 Duplicate Charges — Full Refund of Duplicate

If you are charged more than once for the same report (identical property address and project scope submitted within a 24-hour period), the duplicate charge will be refunded in full. To qualify:

  • Both charges must be for the same property address;
  • Both charges must be for substantially the same project scope;
  • The duplicate must have occurred within 24 hours of the original purchase.

4.3 Billing Error — Full Refund or Correction

If you are charged an incorrect amount (e.g., incorrect HST calculation, wrong price tier applied), the Company will either:

  • Refund the difference between the amount charged and the correct amount; or
  • Issue a full refund and allow you to repurchase at the correct price.

5. Scenarios Not Eligible for Refund

IMPORTANT — PLEASE READ BEFORE PURCHASING

The following scenarios are explicitly excluded from refund eligibility. By completing your purchase, you acknowledge that you have read and understood these exclusions.

The following are not eligible for refund:

5.1 Dissatisfaction with Report Content

Reports are AI-generated informational summaries with clearly disclosed limitations. Refunds are not available because:

  • You are dissatisfied with the level of detail, specificity, or depth of the report;
  • You expected the report to contain information that falls outside its stated scope;
  • You believe the report should have included municipality-specific by-law text (the Service uses general Ontario regulatory context);
  • You disagree with the AI's confidence ratings or risk assessments.

5.2 Permit or Regulatory Outcomes

As stated in our Disclaimers and Terms of Service, the Service does not guarantee any regulatory outcome. Refunds are not available because:

  • Your building permit application was denied by the municipality;
  • Your municipality imposed conditions, delays, or additional requirements;
  • A conservation authority required additional permits or assessments;
  • Actual development charges, fees, or timelines differed from the report's estimates;
  • Zoning, setback, or other regulatory information in the report differed from what your municipality confirmed.

5.3 Failure to Review Disclaimers

Before completing your purchase, you are required to acknowledge our disclaimers and accept the click-wrap indemnity agreement. Refunds are not available on the basis that you:

  • Did not read the disclaimers, limitations, or terms before purchasing;
  • Did not understand the informational nature of the report;
  • Expected the report to constitute professional advice (legal, engineering, architectural, or planning);
  • Expected the report to serve as a permit application or pre-approval.

5.4 Third-Party Reliance

Refunds are not available for losses or claims arising from a third party's reliance on your report, including:

  • A client, buyer, or investor who relied on the report in a real estate transaction;
  • A contractor or subtrade who used the report for project planning;
  • Any party to whom you shared or forwarded the report.

5.5 Change of Mind

Due to the immediate digital delivery nature of the product, refunds are not available for change of mind after the report has been generated and delivered. This is consistent with the treatment of digital content under the Consumer Protection Act, 2002 where the consumer has consented to immediate performance.

6. How to Request a Refund

To request a refund for an eligible scenario, follow these steps:

  1. Submit your request within 14 calendar days of your original purchase date by emailing [email protected];
  2. Include the following information:
    • Your full name and the email address associated with your account;
    • The date of purchase;
    • Your Stripe payment receipt or transaction ID;
    • The property address associated with the report;
    • A clear description of the issue and the refund scenario that applies (Section 4).
  3. Await our response. We will acknowledge your request within 2 business days and provide a final decision within 5 business days of receipt.

7. Refund Processing

Approved refunds are processed as follows:

  • Method: All refunds are issued through Stripe to your original payment method. We do not issue refunds by cheque, cash, e-transfer, or alternative payment methods.
  • Timeline: Refunds are initiated within 3 business days of approval. Processing time depends on your financial institution, typically 5–10 business days for the credit to appear on your statement.
  • HST: Refunds include any applicable HST that was charged on the original transaction.
  • Currency: Refunds are issued in Canadian Dollars (CAD), the same currency as the original transaction.

8. Chargebacks and Disputes

We encourage you to contact us directly before initiating a chargeback or payment dispute with your financial institution. We are committed to resolving issues fairly and promptly.

If you initiate a chargeback without first contacting us:

  • We will respond to the chargeback with documentation of the transaction, delivery confirmation, and your acceptance of the click-wrap indemnity agreement;
  • Fraudulent chargebacks (where the product was delivered as described) may result in account suspension;
  • We reserve the right to recover costs associated with fraudulent chargeback disputes, including administrative fees charged by our payment processor.

9. Ontario Consumer Protection Rights

This Refund Policy is designed to comply with the Consumer Protection Act, 2002, S.O. 2002, c. 30, Sched. A, and Ontario Regulation 17/05 (General) thereunder. Nothing in this policy is intended to limit or exclude any rights you may have under applicable Ontario consumer protection legislation that cannot be waived or limited by agreement.

Under the Consumer Protection Act, 2002:

  • You have the right to receive a copy of your agreement (these Terms and this Refund Policy are available at any time on our website);
  • You have the right to receive the goods or services as described (our Service description, disclaimers, and limitations are clearly disclosed before purchase);
  • You have the right to cancel an internet agreement within 7 days if the required disclosure was not provided, or within 30 days if the goods or services were not delivered — however, as our digital product is delivered immediately, this cancellation right is satisfied upon delivery;
  • Unfair practices, unconscionable representations, and false advertising are prohibited regardless of any contractual terms.

10. Promotional Codes and Discounts

If your purchase was made using a promotional code or discount:

  • Refunds (where eligible) will be issued for the amount actually paid after the discount was applied;
  • Promotional codes are single-use and will not be reissued upon refund;
  • The Company reserves the right to void promotional codes that were obtained through fraud, error, or unauthorized distribution.

11. Policy Modifications

The Company reserves the right to modify this Refund Policy at any time. Changes will be posted on this page with an updated "Last updated" date. The Refund Policy in effect at the time of your purchase governs that transaction. Material changes will not be applied retroactively to purchases made before the change.

12. Governing Law

This Refund Policy is governed by and shall be construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein. Any disputes arising from this policy shall be subject to the dispute resolution provisions in our Terms of Service.
